1. Acceptance
By using BookyPay, you agree to these terms. If you do not agree, please do not use the platform.
2. Definitions
"Owner/Merchant": the entity that creates payment links and provides the product/service. "Customer": the buyer or service requester. "We/BookyPay": the platform operated by COMPANY ASTAD FOR INFORMATION TECHNOLOGY.
3. Service nature and our intermediary role
BookyPay is a technology intermediary that enables creating payment links and facilitates collection via external payment providers. We are not a party to the sale/purchase and do not warrant the quality of products/services or the obligations of any party. All contractual obligations rest with the owner/merchant and the customer.
We provide the surface where the owner configures the payment amount, currency, description, and optional attachments. Customers access the link to review those details before being redirected to the payment provider’s hosted checkout to complete payment. We do not collect or store card data, and settlement happens directly between the provider and the owner in line with their commercial agreement.
4. Account and acceptable use
- You agree to provide accurate information and keep your login credentials confidential.
- You must not use the platform for activities that are unlawful or pose high financial/legal risks.
- We may suspend any account that violates these terms or poses a risk to the platform or others.
- When issuing payment links you must present truthful descriptions, amounts, and taxes so that customers can make an informed decision before paying.
- If you connect messaging channels (such as WhatsApp) you must obtain and maintain the customer consents required under applicable laws before sending any message.
5. Fees and taxes
Fees may apply to certain services and will be disclosed when applicable. The owner/merchant is responsible for taxes and statutory fees related to their activities.
6. Intellectual property
All IP rights in the platform and its content are owned by or licensed to BookyPay. You may not copy, modify, or resell any part of the platform without prior written consent.
7. Disclaimer
The platform is provided "as is" and "as available" without any express or implied warranties. We do not warrant that the service will be error-free or uninterrupted.
8. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential damages or loss of profits. Our total liability for any claim is limited to the fees you paid us in the 12 months preceding the claim (if any).
9. Indemnity
You agree to indemnify BookyPay against any claims arising from your misuse of the platform or breach of these terms.
10. Termination
We may suspend or terminate access to the platform in whole or in part for violations of the terms or for security reasons.
11. Governing law and jurisdiction
These terms are governed by the laws of the Kingdom of Saudi Arabia. The competent courts in Jeddah shall have jurisdiction over any dispute.
12. Changes
We may update these terms from time to time. Your continued use of the platform after posting constitutes acceptance of the changes.
13. Payment links and customer payments
Payment links are unique URLs generated by the owner/merchant. Customers should verify the amount, description, and owner identity displayed on the link before proceeding. Once redirected, the payment provider processes the transaction under its own terms and security controls.
BookyPay provides confirmation screens and notifications but does not handle customer funds or provide escrow services. Any receipts or invoices are issued by the owner/merchant.
14. Disputes, refunds, and chargebacks
The owner/merchant is solely responsible for customer support, fulfilment, refunds, cancellations, and handling disputes arising from payment links. Customers must contact the owner/merchant directly for any service-related issues.
If a chargeback or dispute is initiated with the payment provider, the owner/merchant agrees to cooperate with the provider’s process and supply evidence when requested. BookyPay may share link metadata to support the investigation but is not responsible for the outcome.
15. WhatsApp messaging and API access
You may authorise BookyPay to trigger WhatsApp messages through your connected account or Business API provider. You remain the sender of record and are responsible for the content, audience, and compliance of all messages. WhatsApp policies, PDPL, and customer consent requirements must be respected at all times.
API tokens and phone numbers supplied to BookyPay must be kept secure. We use them only to deliver instructions that you initiate (for example, notifications about payment links or transaction updates). You must not share credentials belonging to third parties or use the service to send unsolicited or abusive content.
We may log delivery metadata (timestamps, message IDs, status) to monitor service quality and fraud. We may suspend or revoke messaging access if you breach applicable rules or if your integration poses a risk to customers, WhatsApp, or BookyPay.
